QLD Seller Disclosure Statement Acknowledgement
Question: Do contracts need to include a checkbox for the Buyer to confirm that they have seen the Seller Disclosure Statement?
A checkbox can be included, but it is not legally required.
Under the new disclosure regime, the Seller Disclosure Statement process already contains built-in protections:

Seller signs the disclosure statement when preparing it.

Buyer signs the disclosure statement before entering the contract, acknowledging that they have received it.

Contract signing occurs after disclosure is complete – the Buyer signs the contract (having acknowledged disclosure), and then the Seller signs.
Because of this structure, the Buyer has already formally acknowledged receipt of the disclosure statement. Adding an extra checkbox in the contract is therefore not required.
Why a checkbox is unnecessary

The legislation does not require it.

The Buyer’s signed acknowledgement on the disclosure statement itself is sufficient.

A checkbox does not protect the Seller from a Buyer’s claim about incorrect or incomplete disclosure – remedies remain available to the Buyer regardless.
The addition of a checkbox or other acknowledgement in contracts does not add any additional legal protection and is not required for compliance.
