NSW Leases | Special Terms

You can add any negotiated special terms to the tenancy agreement using the Special Terms section on Page 20 of the ADL NSW Residential Tenancy Agreement (form NSW-PM-001). This allows you to include additional conditions that reflect unique arrangements agreed upon between the landlord and tenant.

✅ Where to Enter Special Terms

  • Navigate to Page 20 of the Residential Tenancy Agreement.

  • Locate the section titled "ADDITIONAL TERMS".

  • Within this section, you will find a free-text field or merge field for inserting your own clauses:

This is the designated space for inserting custom special conditions, such as:

  • Requirements about cleaning or gardening

  • Conditions on short-term guests

  • Rules about use of certain appliances or areas

  • Pet restrictions or arrangements (if not already included elsewhere)

✍️ How to Add a Special Term

  1. Click into the field or prompt on Page 20 where special terms can be entered.

  2. Type or paste your special term in plain language. Example:

    "The tenant agrees to professionally steam clean all carpets at the end of the tenancy."

  3. Repeat for additional terms — you can include multiple special conditions as long as they are clear and lawful.

📌 Important: Any additional terms:

  • Must be agreed to by both landlord and tenant

  • Must not conflict with the Residential Tenancies Act 2010 (NSW) or standard terms of the agreement

  • Should be drafted clearly and reasonably

🛡️ Tips for Legal Compliance

  • Avoid terms that waive a tenant's statutory rights (these may be unenforceable).

  • If in doubt, seek legal advice or refer to NSW Fair Trading guidelines.

  • Ensure both parties initial and date the additional terms if printed, or ensure visibility in the digital copy if signed electronically.

🔄 Editing Special Terms Later

If a change is required:

  • Create a new version of the agreement (if unsigned), or

  • Use a signed addendum agreed by both parties (if agreement has already been signed)
