New NSW Forms | May 2025
Effective 19 May 2025, significant amendments to NSW rental laws will impact tenancy forms and procedures, including those on ADL Forms Online.
- Landlords must now provide a valid reason when terminating a lease, accompanied by an information statement outlining both parties' rights and responsibilities.
- Depending on the reason for termination—such as sale, major renovations, demolition, or personal occupancy—landlords are required to furnish supporting documentation.
- Additionally, re-letting restrictions apply, preventing the property from being re-leased for specified periods, ranging from 4 weeks to 12 months, based on the termination reason.
- Notice periods for ending leases have also been extended to at least 60 days for fixed-term leases of 6 months or less, and at least 90 days for longer fixed-term or periodic leases.
These changes have necessitated updates to tenancy forms to ensure compliance with the new legal requirements. As a result, the following forms have been updated on ADL:
- Residential Tenancy Agreement (Standard Form only) (AU-NSW-RE-PM-043) - The prescribed form of tenancy agreement under the Residential Tenancies Act 2010 (NSW) with no additional terms of conditions added.Updated to reflect legislative changes.
- Residential Tenancy Agreement (with extra terms) (AU-NSW-RE-PM-001) - The prescribed standard of tenancy agreement under the Residential Tenancies Act 2010 (NSW) with additional terms added that impose additional rights and obligations on the parties. Updated to reflect legislative changes.
- Notice of Termination (AU-NSW-RE-PM-007) - Updated to reflect legislative changes, including inclusion of new termination reasons.
Additionally, the following have been removed:
- Notice of Termination (Death of a Tenant) (AU-NSW-RE-PM-057) - Removed as this reason for termination is now contemplated in the Notice of Termination (AU-NSW-RE-PM-007).
- Residential Tenancy Agreement(with extraterms - letting only) (AU-NSW-RE-PM-023) - Removed on recommendation by our external legal counsel. Residential Tenancy Agreement (with extra terms) (AU-NSW-RE-PM-001) can be used instead.
- Residential Tenancy Agreement (By-Laws Included) (AU-NSW-RE-PM-047) - Removed on recommendation by our external legal counsel. Residential Tenancy Agreement (with extra terms) (AU-NSW-RE-PM-001) can be used instead, noting that Agent's will need to also provide a copy of the by-laws for the scheme to the tenant. This can be done through Hutly Sign when sending the lease to the Tenant.
