Can an agent request changes to NSW forms?

No, ADL Forms cannot accommodate customisation requests for NSW real estate forms.

ADL forms are drafted by our external legal counsel, specialists in NSW property law, and are carefully constructed to ensure legislative compliance and regulatory integrity.


Why can’t the forms be customised?

ADL forms—particularly those used in New South Wales—are designed to meet the strict requirements of:

  • The Property and Stock Agents Act 2002 (NSW)

  • The Residential Tenancies Act 2010 (NSW)

  • Associated Regulations and Fair Trading guidelines

Many forms, such as agency agreements, residential tenancy agreements, and notices to terminate, are prescribed by law. This means:

  • Their structure, wording, and mandatory warnings are set in legislation

  • Any alteration or omission may result in non-compliance or unenforceability

  • They must be used as issued, including all relevant disclosure and warning statements

For this reason, ADL Forms must remain legally accurate, standardised, and consistent, and cannot be altered to suit individual agency preferences.


Who drafts the forms?

ADL Forms are prepared by external legal experts with extensive experience in property law and real estate compliance in NSW.

  • Annexures

You may use these sections to include custom clauses, as long as they:

  • Do not conflict with prescribed terms

  • Are lawful, fair, and clearly written

  • Are inserted in the appropriate area as allowed by law
